Mighty Enterprises Inc. DBA Mighty Dumpsterz Terms of Use
Roll-Off Dumpster Rental Terms and Conditions

Mighty Enterprises Inc. DBA Mighty Dumpsterz, a U.S. company based in Edgewood, New Mexico, agrees to rent specific dumpster equipment (“Equipment”) to customers (“Customer”) under the terms and conditions outlined below. These terms, including any related rental documents (collectively referred to as “Rental Documents”), apply to both commercial and residential rentals unless specified otherwise.

Acceptance and Contract Formation
This transaction, including Mighty Dumpsterz's rental of Equipment to Customer, is expressly limited to and conditioned upon Customer’s acceptance of these terms and any related Rental Documents, including quotations, proposals, acknowledgments, and/or invoices. These terms govern all Rental Documents, forming the entire agreement between Mighty Dumpsterz and Customer. Any additional or differing terms provided by Customer are specifically rejected and excluded.

Order Processing
All rental orders are processed through Mighty Dumpsterz's online order form. Orders are considered binding once Customer completes the online process and signs the rental agreement. Customer is responsible for scheduling Equipment delivery and pick-up as per the terms.

Delivery and Pick-Up
Mighty Dumpsterz will make every effort to ensure timely delivery and pick-up of Equipment; however, external factors such as weather, road conditions, and equipment issues may result in delays. Mighty Dumpsterz is not liable for costs or damages arising from such delays. Customer agrees not to move the Equipment from the designated site without written consent. A $125 inconvenience fee may apply if Mighty Dumpsterz cannot access Equipment due to blocked access or other obstructions (a “dry run”), and this fee may be charged to Customer’s payment method.

Prices and Payment Terms
Rental prices are clearly listed on the Mighty Dumpsterz website and in the online order form. Charges are billed per rental term, and Customer authorizes Mighty Dumpsterz to retain and charge the payment method provided for rental fees, Overload Fees, and any other applicable charges, valid for up to 120 days beyond the rental term. If authorization is revoked, Mighty Dumpsterz may immediately terminate the rental agreement without notice and recover equipment.

Cancellation and Fees
Orders cannot be canceled without Mighty Dumpsterz’s approval. Approved cancellations will incur a $125 fee if canceled after noon the prior business day. Consider paying for cancellation insurance or opting for our premium service, which includes cancellation coverage if you are unsure about your situation.

Weight Restrictions and Overload Fees
Customer is responsible for complying with Equipment weight limits. Overloads incur an additional fee of $0.10 per pound over the limit for standard service and $0.05 per pound for premium service, charged to the Customer’s payment method or immediately invoiced.

Permits
Customer is responsible for obtaining any necessary permits for Equipment use. Mighty Dumpsterz may retrieve Equipment without liability if local permits are not obtained.

Prohibited Substances
Hazardous materials, such as tires, batteries, and paints, are prohibited in Equipment. Customer is liable for any damages or charges arising from prohibited substances. If customer attempts to hide materials they are liable for 200% of dump fines incurred by Mighty Dumpsterz as a result.

Indemnification
Customer agrees to indemnify Mighty Dumpsterz for any claims, losses, or damages from misuse of Equipment, failure to obtain permits, or any breach of these terms.

Waiver, Limitation of Liability, and Disclaimer of Warranties
CUSTOMER WAIVES ALL CLAIMS AGAINST MIGHTY DUMPSTERZ FOR DAMAGES RELATING TO THE EQUIPMENT RENTAL, INCLUDING DAMAGE TO PROPERTY OR UNDERGROUND UTILITIES. EQUIPMENT IS PROVIDED “AS-IS” WITHOUT WARRANTIES OF ANY KIND.

Governing Law
Disputes shall be governed by New Mexico law.

Assignment
Customer may not assign this rental agreement without Mighty Dumpsterz's prior written consent.

Reservation of Rights
Mighty Dumpsterz reserves all legal and equitable rights.

Entire Agreement
These terms and the Rental Documents form the entire agreement. No modifications are valid unless approved in writing by Mighty Dumpsterz.
